Terms of Service

1. Provider, scope, contract language

(1) These Terms apply to all contracts between you and Michael Voigtmann, sole trader, brand Petfinity.io (“we”), Zeißstraße 20, 09131 Chemnitz, Germany, email: hello@petfinity.io, phone: +49 1522 5134529.

(2) They apply to petfinity.io, next.petfinity.io and bio.petfinity.io. Besides the general rules, only the service module of the contract you conclude applies.

• Module A — account and free use (Stardust),
• Module B — memberships (Star Keeper, Eternal Star, Founding Member),
• Module C — commissioned digital memorial media (Memorial Portrait, Short Memory, Personal Tribute, Eternal Memory Film),
• Module D — instant tools: automatically created single results from one photo (Petfinity Studio).

A media order is not a membership and does not grant Eternal Star or Founder status; a membership does not include media orders.

(3) Your own conflicting terms do not apply.

(4) The contract language is the language of your order (German, English, French or Spanish); if language versions differ, the version more favourable to you applies.

(5) Purchases require that you are of legal age or have your legal guardians’ consent; an account is possible from the age of 16.

2. Conclusion of contract, corrections, contract text

(1) Account: By registering with email and password or with your Google account you conclude a contract for free use (Module A). For email registration it is concluded when you confirm your email address. When registering you expressly accept these Terms.

(2) Purchases: Our presentation of offers is not binding. Before payment you see an overview (service, total price, where applicable term and renewal); with the payment button you place a binding order (processed by Stripe). The contract is concluded with our confirmation by email or when the service is activated or started, whichever comes first.

(3) Until payment you can correct entries using the back buttons and input fields, or cancel.

(4) We store the contract text; you receive these Terms and the withdrawal information with the order confirmation. Current version: https://next.petfinity.io/legal/terms.

3. Module A — Account and free use (Stardust)

(1) With an account you can create stars for your pets, add photos and memories, keep stars private or show them publicly, and leave gestures at other stars.

(2) Actions at your own star are free. Gestures at other people’s stars cost Sparks: candle 1, flowers 2, treat 1, tribute 0. Coins have no monetary value and cannot be bought, transferred or paid out.

(3) We may develop, change or discontinue free features; we will inform you of material restrictions with reasonable notice. There is no entitlement to uninterrupted availability; maintenance and disruptions may temporarily limit use.

(4) You can end the free contract at any time by deleting your account in the settings or requesting deletion by email.

4. Module B — Memberships

(1) The final price shown before ordering applies, including VAT. Star Keeper is available with monthly or yearly billing and the same benefits.

(2) Account benefits: As long as a star on your account has an active paid plan: 15 Sparks per day (up to 90 saved) and 25 successful interactions with Petfinity AI per rolling 30 days, where the AI feature is available.

(3) Per star: Star Keeper and Eternal Star apply only to the star for which they were purchased or redeemed. A chosen position is kept; no existing star is displaced.

(4) Founding Member includes Founder status for the account and exactly one Eternal Star voucher for one of your stars; paid benefits only start once you assign it to a star in the app. It can be purchased only once per account, including after a withdrawal or refund. No equity, profit participation or entitlement to future tokens.

The voucher does not expire. On withdrawal or full refund, the assignment and the Founder status end; the star returns to the Stardust benefits, saved content is kept.

(5) Star Keeper — term, renewal, cancellation

Monthly billing:

• Term of one month from conclusion of the contract, renewed by one month each time unless you cancel; €3.99 monthly in advance via your stored payment method.
• Cancel at any time to the end of the paid month, with no further notice period; we do not send reminders before monthly renewals.

Yearly billing:

• Initial term of 12 months from conclusion of the contract; you pay the €29 in advance when ordering.
• If you do not cancel by the end of the initial term, the contract continues indefinitely and can then be cancelled at any time with one month’s notice. We then charge €29 annually in advance to your stored payment method; if the contract ends before the end of a paid year, we refund the remainder pro rata.
• Before every renewal payment we remind you by email 15 to 30 days in advance, stating the amount, the date and how to cancel.

For both (how to cancel: section 11):

• You switch billing through our support: the current contract ends with its paid period, then the new one starts; both at once for one star is not possible.
• When Star Keeper ends, the star returns to the Stardust benefits. Its position and saved content remain; you can add new content once the total is below the free limits.

(6) Eternal Star is paid once, has no time limit and is not terminated by us by ordinary notice. If we discontinue Petfinity as a whole, we will announce this by email with reasonable notice and let you download your images and memories beforehand; statutory rights remain unaffected.

(7) Payment: via Stripe with the payment methods offered there, due when ordering; activation after receipt of payment, usually immediately. If a renewal payment is overdue, we may block new paid selections (such as choosing a position) until it is settled; existing content remains.

5. Module C — Commissioned digital memorial media

(1) We create digital memorial media from your photos and details on commission. Scope per offer:

The overview before payment is decisive, with price and currency. Not every photo appears in the result; additional photos serve as reference.

(2) You can also order without an account.

(3) Start and delivery: If you expressly request an immediate start before payment, the delivery time runs from receipt of payment; otherwise we start after the withdrawal period and the delivery time runs from then. Business days are Monday to Friday excluding public holidays in Saxony, Germany. We deliver by email with a download link; please save the files, we do not owe permanent availability of the link.

(4) Design and AI: The media are artistic interpretations, created with AI tools and reviewed by us. We only promise a particular effect or exact likeness if the overview provides so; agreed characteristics and statutory remedies remain unaffected.

(5) Adjustments: Included are design adjustments (such as text, colour tone, framing). Deviations from the agreed content (such as a wrong name or a defective file) are fixed free of charge regardless, as a defect. Anything further (a different concept, additional pets, re-creation) only by separate agreement before any further payment.

(6) Your cooperation: You provide suitable photos and details and confirm before payment that you may use them for this. We ask for new photos if they are unsuitable.

(7) Usage rights: You receive a simple, non-transferable right, unlimited in time and territory, to use the media privately and non-commercially, including storing, printing and sharing them privately and on your own social media profiles; included music and sounds only together with the media.

(8) No advertising with your content: Without your separate, voluntary consent we do not use your photos, details or media for advertising, examples or portfolios; we do not train AI models with them.

(9) If you publish the media, we recommend saying they were made with AI.

5a. Module D — Instant tools (Petfinity Studio)

(1) Service: From one uploaded photo we automatically create one result, with or without an account, at the price shown beforehand including VAT.

(2) Automatic, without personal review: The result is created by an AI service (Magnific, Freepik Company S.L., Spain) without human review. It can differ from your photo: when restoring, the AI fills in detail that was not visible; the portrait is a new image, the clip shows generated movement. We do not owe a particular likeness or effect; remedies for defects remain unaffected.

(3) Start and delivery: We start right after the order, with your prior express consent (see the withdrawal information), without a promised duration. You receive the download link by email; we delete the result and the photo after 30 days.

(4) Payment: You are only charged once the result is ready; until then the price is merely reserved on your card or in your Studio credit. If creation fails for technical reasons even after an automatic second attempt, we release it or return it to your credit; an amount already paid is refunded in full.

(4a) Crystals (Studio credit): You buy Crystals in the app in packs, for the amount shown, in the currency offered. A Studio order or an additional Petfinity AI answer costs the number of Crystals shown beforehand — whatever currency you bought them in; nothing is converted. Crystals do not expire and are never topped up automatically; Sparks (section 3 (2)) do not pay for Studio orders. We refund unused purchased Crystals if you withdraw from the purchase and, on request, if you delete your account: for each purchase, the share of the amount paid that falls on the Crystals of that purchase not yet used, in the currency of that purchase; Crystals are used from the oldest purchase first. Credit bought in a currency before 29 September 2026 remains and continues to pay for orders in that currency.

(5) Variants: Every further variant is a new order at the price shown; free re-runs are not included.

(6) Your photos: You confirm that you may use the photo for this order and that it does not show other people without their agreement. We use it only for this order, not for advertising or AI training.

(7) Usage rights and labelling: You receive a simple, non-transferable right, unlimited in time and territory, to use the result privately and non-commercially, including storing, printing and sharing it privately and on your own social media profiles; included music only together with the clip. Results are labelled as made with AI; saved to one of your stars, they have the same visibility as your other photos.

6. Your content, publication, moderation

(1) You retain your rights in uploaded content. You grant us a non-exclusive licence to store, process and display it as needed to provide the agreed service. Public display follows your visibility settings. The licence ends when you delete the content or your account, unless statutory retention obligations apply. It does not transfer ownership and does not include a licence for advertising or for training AI models.

(2) Visibility: New stars are private. A star only becomes public when you expressly choose so. Then the following is visible to everyone and can be found via search engines: name, species, breed, description, dates of birth and passing, country, tier and Founder mark, portrait, gallery images, candles and tributes with the names of their authors. Memories of public stars are only visible to signed-in visitors.

(3) Only upload content for which you have the necessary rights and permissions. Illegal content, harassment, deception, spam and abusive use — such as automated access or circumventing limits — are prohibited.

(4) Reports and moderation: You can report illegal content via Report content; you will receive an acknowledgement of receipt and our decision. Reports are reviewed by a human; we do not use automated tools to detect or remove user content. Measures — removing content, restricting visibility, suspending an account for serious or repeated violations — are proportionate, and we inform those affected with reasons and the option to complain.

(5) We do not suspend or end paid services without an objective reason. If we end a paid contract for a reason you are not responsible for, we refund prepaid fees on a pro-rata basis.

7. Petfinity AI

(1) Petfinity AI is an AI chat. Its answers are generated by a language model, not written by a person. AI-assisted images and responses are generated interpretations. They are not authentic communications from your pet and do not constitute medical, psychological or veterinary advice.

(2) Petfinity is a remembrance and creative service. We do not provide medical or psychotherapeutic treatment, diagnosis, crisis intervention or emergency care. AI answers do not replace professional advice or treatment. If the chat detects signs of an acute emergency, it points to sources of help.

(3) The number of interactions depends on your plan (sections 3 and 4). Features identified as beta are under development and may have limitations; this does not restrict your statutory rights concerning the agreed service.

8. Scope of service

You are owed the services described when ordering; announced features only if expressly promised as included.

9. Statutory remedies

Statutory warranty rights apply, for digital products including §§ 327 et seq. of the German Civil Code (BGB).

10. Liability

We are liable without limitation for intent and gross negligence, for culpable injury to life, body or health, under a guarantee, and under product liability law and other mandatory law. In other cases of ordinary negligence we are only liable for breaches of essential contractual duties (duties whose performance makes the contract possible and on which you may rely), limited to the loss foreseeable and typical of the contract at its conclusion; this also applies to our representatives and persons engaged to perform our obligations.

11. Cancellation and withdrawal

(1) You can cancel ongoing contracts via Cancel contracts here (without signing in), by email to hello@petfinity.io or in the app; you receive a confirmation of receipt by email immediately. If you are signed in, we execute the cancellation at once; if not, to protect you against third parties, only after you confirm it via the link sent to your account’s email address. We tell you the end of the contract in writing.

(3) Both parties’ right to terminate for good cause remains unaffected.

12. Privacy

For how we process personal data, see the Privacy Policy; accepting these Terms is not consent to it.

13. Changes to these Terms

New versions apply only to contracts concluded later; we only change existing contracts with your express consent or where the law permits. Earlier versions remain available.

14. Governing law, jurisdiction

German law applies; mandatory consumer protections of your country of habitual residence and statutory places of jurisdiction remain unaffected. There is no arbitration clause and no class action waiver.
