Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (Michael Voigtmann, Petfinity.io, Zeißstraße 20, 09131 Chemnitz, Germany, phone: +49 1522 5134529, email: hello@petfinity.io) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

You can also exercise your right of withdrawal online at https://next.petfinity.io/legal/withdraw. If you use this online feature, we will send you an acknowledgement of receipt of the withdrawal on a durable medium (e.g. by email), including its content and the date and time of its submission, without undue delay.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated us your withdrawal from this contract, in comparison with the full coverage of the contract.

Performance starting during the withdrawal period

The following information is not part of the withdrawal information above.

For services, the right of withdrawal expires on full performance if we only began after you expressly requested it and confirmed that you lose the right once we have fully performed the contract.

• Star Keeper starts right after payment; beforehand you expressly request the start during the withdrawal period. If you withdraw within the period, we refund the amount paid minus the share for the time until the withdrawal.
• Eternal Star and Founding Member start right after payment; beforehand you expressly request the start during the withdrawal period. If you withdraw within the period, we refund the full amount.
• Memorial media: Before payment you decide whether we start immediately; otherwise we start after the withdrawal period and delivery moves accordingly. If you requested the early start and confirmed you are aware of the loss of the right, the right of withdrawal expires on complete delivery.
• Petfinity Studio: The result is digital content that we create automatically right after the order. Before ordering you therefore expressly consent to our starting before the withdrawal period ends and confirm that your right of withdrawal ends when creation begins (section 356 (6) German Civil Code); no compensation is owed (section 357a (3)). Without this consent no order can be placed.

Refunds

We offer no additional voluntary money-back guarantee; to the extent permitted by law, non-use or a change of mind does not entitle you to a refund. Statutory rights remain unaffected.

If a membership is withdrawn from or refunded, its benefits end; the star remains with the free Stardust benefits.

Crystals: If you withdraw from a Crystal purchase, we refund the share of the amount paid that corresponds to the unused Crystals of that purchase, in the currency of that purchase. Studio orders paid with Crystals are separate contracts; for them the right of withdrawal ends when creation begins, if you consented to this before ordering.

Whether a right of withdrawal exists depends on the law applicable to your contract (Terms, section 14), not on the payment currency or language; the online function, open to everyone, does not extend it.
